A. Except single-family residential parcels and undeveloped parcels, every parcel of real property that has been developed or redeveloped on or after March 10, 2003, and disturbs greater than or equal to one acre in size or projects of less than one acre that are part of a larger common plan of development which collectively disturbs land area equal to or greater than one acre, is required to have its owner enter into an agreement with the city that outlines the responsibilities of the owner for long term stormwater management. This agreement will be recorded with the Salt Lake County recorder’s office and will be binding on future parcel owners. Any party unwilling to enter into this agreement may be denied a business license or have its business license suspended or revoked.

B. Every owner of a parcel of real property that is required to enter into an agreement under this section is required to provide a biannual report to the city that outlines the maintenance procedures used to keep the parcel’s stormwater facilities functioning properly.

C. Every owner of a parcel of real property that is required to enter into an agreement under this section will also be required to develop and submit to the city a LTSWMP. The owner of a parcel of real property is solely responsible for the operation and maintenance of stormwater facilities located on the parcel. The stormwater facilities must be adequately maintained, perform in a working manner, and comply with the terms of any agreement entered into under this section and with the Utah Water Quality Act, Title 19, Chapter 5 of Utah Code Annotated, as amended. At a minimum, the LTSWMP must contain the following information and a description of every BMP utilized for each category:

1. As-built drawings: provide an electronic copy of as-built drawings showing the overall site, drainage plan, and all stormwater facilities including: inlet boxes, pipes, detention and retention areas, all low-impact development (LID) elements, flow restriction devices, and connection to the stormwater system;

2. Parking, sidewalk and flatwork: describe impervious surfaces and how the maintenance proposed will affect water quality;

3. Landscaping: describe the landscape elements used on site and how its presence and maintenance practices will affect water quality;

4. Storm drain system: describe the elements of the storm drain system and how its presence and maintenance practices will affect water quality;

5. Waste management: describe the waste management infrastructure and how its maintenance practices will affect water quality;

6. Utility system: describe the utility infrastructure and how the maintenance practices will affect water quality;

7. Snow and ice removal management: describe snow and ice removal operations and how those practices will affect water quality; and

8. Equipment/outside storage: describe any outside storage facilities or operations and how they will impact water quality. (Ord. 2021-20 § 1 (Att. A); Ord. 2017-07 § 1 (Exh. A))
