8.06.280 Negligent discharge of fireworks.
A. It shall be unlawful to improperly use or discharge a class C common state approved explosive within Midvale City in any negligent, reckless, or willfully improper manner.
B. Improper use or discharge of a class C common state approved explosive includes, but is not limited to, the following:
1. Use or discharge of a class C common state approved explosive in such a manner that the explosive projects over or onto the property of another without the consent of the other owning or controlling such property.
2. Use or discharge of a class C common state approved explosive from or into any motor vehicle, or at or near any person.
3. Use or discharge of a class C common state approved explosive in such a manner as to cause any building, structure, or other property to catch fire.
C. In this section, “negligent” means the failure to exercise the degree of care that a reasonable and prudent person exercises under similar circumstances.
D. A violation of this section is a class B misdemeanor. (Ord. 2023-12 § 1 (Att. A))
